Welcome to the Lomax Maix Legal app (the “App”). By downloading, using, or interacting with this App, you agree to the following Terms and Conditions. Please review them carefully.

1. Acceptance of Terms

By using this App, you confirm that you understand and accept these Terms and our Privacy Policy. If you do not agree, please do not use the App.

2. Changes to Terms

We may update these Terms at any time. Changes take effect when posted. Continued use of the App means you accept the updated Terms.

3. Use of the App

You are granted a limited, non-transferable license to use the App for personal, non-commercial purposes. You may not:

• Copy, modify, or distribute the App;

• Use the App for unlawful purposes;

• Reverse engineer any part of the App.

4. User Accounts

Some features require you to create an account. You agree to:

• Provide accurate information;

• Keep your login credentials secure;

• Notify us of unauthorized use.

We may suspend or terminate accounts for violations of these Terms.

5. Privacy

We are committed to protecting your data. Personal information you share is used only to determine class action eligibility or manage your legal representation. See our full Privacy Policy for details.

6. Limited Representation

Your relationship with Lomax Law Firm is limited:

• You are not a client until you apply for a class action, are accepted, and sign a litigation-specific agreement.

• Representation is limited to class action matters listed in the App.

• You are free to work with other attorneys for unrelated matters.

7. Attorney-Client Relationship

• A formal attorney-client relationship begins only when you sign a contract for a specific litigation.

• Signing a contract in-app covers only that litigation—not all legal issues.

• Communications with attorneys are confidential once a contract is signed.

8. Chat Disclaimers

AI Chat

Our Maix AI assistant, powered by ChatGPT, is for general information only:

• It is not a lawyer and cannot give legal advice.

• Your chat does not create an attorney-client relationship.

• Please avoid sharing sensitive or personal details.

Attorney Chat

If you chat with a licensed attorney:

• Your conversation may be protected under attorney-client privilege.

• You are not a formal client until you sign a written agreement in the app.

• No attorney may be immediately available. If urgent, seek help elsewhere.

9. Application Disclaimers

When applying to join a class action:

• Your participation is not guaranteed.

• Deadlines may apply. Late applications may not be accepted.

• Attorneys must review all applications before acceptance.

• Acceptance does not guarantee compensation or any specific result.

• You may withdraw your application at any time before joining.

10. Fees and Contracts

• If your case results in a recovery, a 36% attorney fee will be deducted from the award.

• No recovery = no fees owed.

• You must submit requested documents to remain eligible.

• Signed contracts are available in your dashboard under settings.

11. Signature and PIN

To sign any agreement:

• You must be at least 18 years old.

• You must set up a digital signature and 6-digit PIN in the App.

• Signing with your PIN confirms your legal agreement to the contract terms.

12. Notifications and Communication

• You agree to receive updates, notices, and legal communications via the App.

• It is your responsibility to monitor your app notifications.

13. Account Deletion and Data Retention

Account Deletion and Active Legal Representation

As a law firm, Lomax Law has a legal and ethical obligation to protect our clients' interests, maintain accurate records, and uphold the rules of professional conduct that govern attorneys in the jurisdictions where we practice. These obligations limit when and how client data can be deleted.

If you request to delete your account, but you are currently participating in any active litigation through the Lomax Maix Legal app, your account cannot be deleted until one of the following occurs:

• You provide us with contact information for a new attorney who is assuming responsibility for your representation, so we can facilitate a lawful and ethical transfer of your file, or

• You formally withdraw from the litigation, thereby ending the attorney-client relationship with respect to that matter.

This requirement exists to ensure continuity of representation, prevent prejudice to your legal rights, and comply with our duties under attorney ethics rules, including duties of diligence, competence, and proper client withdrawal.

Clients with active litigation may not proceed with account deletion until one of the above steps is completed. This is necessary to protect both your legal interests and our ethical obligations to you.

Data Retention Following Account Deletion

Even after your account is deleted or access to the app is discontinued, Lomax Law is legally and ethically required to retain certain records related to any representation we provided.

This includes, but is not limited to:

• Signed documents and agreements

• Chat transcripts and communications

• Litigation materials and case data

• System-generated logs and action history

These records are preserved in accordance with the applicable rules of professional conduct, including our duty to maintain client files for a reasonable period of time and to safeguard information that may be relevant to future claims, audits, or legal proceedings.

We retain this data solely for compliance, accountability, and professional responsibility — not for marketing or third-party use. For users who never entered into an attorney-client relationship (i.e., who never signed or joined a litigation), complete deletion of personal data may be available upon request.

13. Jurisdiction and Arbitration

These Terms and your contracts with Lomax Law Firm are governed by Mississippi law.

• Disputes will be resolved via binding arbitration in Hinds County, Mississippi.

• If arbitration is unavailable, legal proceedings will occur in Hinds County courts.

14. Class Action Participation Rules

• The firm may choose not to file if a claim is not legally viable.

• Scope and eligibility may change over time—updated consent may be required.

• Case resolutions may include settlement or dismissal without appeal rights.

• We may withdraw representation for lack of cooperation or breach of contract.

15. Third-Party Services

The App may link to third-party services. We are not responsible for their content or practices.

16. Termination

We may terminate your access if you breach these Terms or misuse the App.

By using this App, you confirm that you have read and agree to these Terms and all related disclaimers.
